So, you have been in an accident with a person who has only “limited” insurance coverage. Is your recovery limited to the amount of that insurance? The answer is “yes, but…”
There are two potential ways to recover more money. The first is through your own “uninsured/underinsured” insurance coverage. For example, if the defendant driver only has $50K in insurance, but you have $100K in liability insurance with the same amount of UM/UIM coverage, you can recover $50K from the defendant’s insurance and an additional $50K from your own.
