We are excited to share that Partner Andy Vickery successfully argued the Mattson case to the Idaho Supreme Court who ruled in favor of our client by vacating the district court’s judgment and remanded the case back to the district court for trial.
The Idaho Supreme Court did so by reversing the district court’s decision that there was no triable jury question under the “reckless, willful and wanton conduct” exception to immunity.
The Court held that Mattson has alleged sufficient facts at summary judgment to demonstrate that a reasonable person could find that Defendants’ acts or omissions were “reckless, willful and wanton[.]” See I.C. §§ 6-904A, 6-904C(2).
